Elder abuse pair prepare for hearing, jury trial in Bakersfield

Joseph McCoy, 30, of Lake Isabella, and his mother, 54-year-old Darlene Green of Weldon, were in Kern County Superior Court again on Thursday, Dec. 29 for a Readiness Hearing. The two face charges of causing harm or death to an elderly person in connection with the April 1,2011 death of Green’s mother, Margaret Gray.

At Thursday’s court appearance, Judge John Brownlee granted a request for the Readiness Hearing to be trailed until Jan. 4. Public Defender, Janice Kim representing McCoy, agreed with the request made by IDP attorney, Fred Gagliardini who was standing in for Green’s attorney, John Tello of Bakersfield, who was out of town due a death in the family.

Gray was found in her home on Reeder St. in Lake Isabella on Feb. 11. She was suffering from extensive bed sores and grade 4 ulcers. According to CARE Paramedic, Nathaniel St. Clair, Gray was found lying in her own feces with areas of her skin stuck to the bed sheets.

Gray was taken to the Kern Valley Hospital where her condition was found to be more severe than first thought. Dr. Manual Sacapano, then-emergency room director for the hospital, testified at the preliminary hearing in July that, “In 11 years, this is the worst case of elder abuse I have ever seen.”

Gray reportedly was transported to Bakersfield and admitted to San Joaquin Community Hospital. Court records show after being treated there, she was moved to Lifehouse, an elderly care facility overseen by Dr. Anthony Milanes in Bakersfield. Gray died from cardio respiratory arrest, sepsis, and Alzheimer’s disease according to the death certificate obtained by the Sun.

McCoy was Gray’s IHSS primary care giver since he turned 18 years old in 1999.

“ This is a great example of why, we as human beings should watch out for one another,” one person wrote on the Kern Valley Sun blog. “If you know an elderly person that is shut in, stop by and say Hey, doesn’t take but a few minutes out of your day to just check on someone, even a quick phone call. Get an understanding with a person that you are just calling to see if they are ok or need something, you never know, you may save a life, the neighborly thing to do, you know?”

Enough evidence was presented at the preliminary hearing in July for Judge David Lampe of the Superior Court of Kern County to hold the two to answer the charges against them.

“Anyone remotely responsible for this woman’s care should get the maximum penalty allowed,” said Lorraine Baynes. “You wouldn’t treat a dog this bad.”

“What a sad story. It's so heartbreaking to read of elder abuse and neglect. This was a major concern of mine when I had to find a caregiver for my aging father,” said A Coyle. “I worried about hiring a stranger for his care, Hopefully more people will learn about (new) software and it will prevent elder abuse. "

McCoy and Green are being held at the Lerdo Pre-trial facility.

    " everyone keeps saying where is the social worker? it doesn't work like that unless there is a complant from the client, or the IHSS Worker says something the social worker doesn't know,i don't think family should be taking care of family in IHSS, and yes taking some kind of training would help alot in caring for an eldry person, BUT THESE PEOPLE THAT DIDN'T DO NOTHING EXCEPT COLLECT A CHECK, THEY KNEW WHAT THEY WERE DOING, I DON'T BELIVE THAT THEY DIDN'T THE COURTS I PRAY THROW THE BOOK AT THEM, AND NO PROBATION!!! "

    " I originally thought that maybe these were just a couple of family members who were over their heads and didn't know how to handle the situation. Then I read an article in the Californian that described the conditions in which this elderly lady was found. Including a bed sore so deep that her tailbone was exposed, two weeks worth of her own feces, and magots surrounded her. I'm sorry but even if I didn't know what to do; I would know I had to do SOMETHING! Call 911; Call social services; do something!!! "

    " Your right - where was the IHSS Social worker. You can tell by the conditions they found that this problem didn't just happen. You can't blame current medicare benefits for this poor womens condition. Let's go back to the social worker..... "

    " To "whatever" i totally agree with you that families should learn more about taking caring of elderly family members. Kinda like what alanon is for families of alcoholics. But the families must want to learn how to take care of the elderly family members. Iv worked in healthcare for a while and its sad how many people do not take care of their family and let them basically rot. "

    " Obviously not being privy to all the details there are couple of things that have bothered me from the beginning.How do family members know what to do when an elderly person refuses to take care of themselves or allow themselves to be taken care of? Fortunately, I've never been put in this situation but hear its common. I think training and classes for people who are going to take care of elders should be provided and required. Just an opinion. "

    " What a sad story! I own Cendecon (cendecon.com) and we see a lot of situations that could be classified as elder abuse. Whoever wrote on the blog to stop by and say hi, or make a phone call to check in on someone is absolutely right!

    We do a lot of unattended death cleanups and it's really sad when we find out that the person had passed away weeks before being discovered. "
